Virginia's 11th Senatorial District Republican Committee and its chairman brought First and Fourteenth Amendment challenges to Virginia's open-primary law, both on its face and as applied to the 2007 election in that district. The federal district court rejected their facial challenge but struck down the law as applied, and a panel of the U.S. Court of Appeals for the Fourth Circuit affirmed. Virginia law authorizes each incumbent state senator to choose among several methods of nomination for his seat. Some of those options would involve only registered Republican voters. The 11th District senator chose a state-run primary, which under state law was required to be an "open" primary, that is, a primary in which Democrats and unaffiliated voters also could participate. The Republican plaintiffs challenged the law as a violation of the party's right to associate freely with others who share their political beliefs.
